MUMBAI: A girl applies for a passport in the name of her step-father, as recorded in school/college certificates. The passport officer refuses to oblige, saying she must obtain a court order appointing her step-father as her guardian.

The girl moves court of law. Judge asks what happens if an woman does not marry? A lawyer, representing the government, replies: “An unwed mother must file an affidavit stating “how she has conceived” and “if she was raped” and why she does not want the father’s name included.”

Believe it or not, this is what happened in the Bomaby High Court on Thursday. Meena Kumari (name changed) challenged an order of a passport officer in the regional passport office, refusing to issue a passport in her name as shed had mentioned the name of her step-father even if his name was mentioned in her school certificate. The girl was told neither could she alternately name her mother who has her permanent custody.

When the HC judge asked, “We were wondering what happens in case of unwed mothers?” the advocate for the Ministry of Foreign Affairs said an unwed mother must file an affidavit stating “how she has conceived” and “if she was raped” and why she does not want the father’s name included.
